Provider and scope

The provider is HolaStudio (trade name), tax ID (NIF) Z0848512R, registered at Calle Zulaida 11, 03170 Rojales (Alicante), Spain. Email: info@holastudiovideo.com. Phone and WhatsApp: +34 613 13 87 84.

These terms govern the contracting of HolaStudio's video and photography services. They apply together with the quote or written proposal for each job. If anything differs, what is written in the accepted quote prevails.

The services are aimed mainly at businesses and professionals: shops, restaurants, estate agencies, developers and holiday accommodation. Private individuals may also contract them, for example the owner of a holiday rental home contracting in a personal capacity: they also enjoy the rights the law grants to consumers, set out below.

How to contract

• You send us your request through the form, WhatsApp, email, phone or a booked call.
• We send you in writing, by email or WhatsApp, a quote or proposal with the service, what is delivered, lead times, the price including VAT and its breakdown, the payment method and, for monthly plans, the minimum term if there is one.
• The contract is concluded when you accept that quote in writing, and we also confirm it to you in writing.

Nothing is contracted or paid on this site: there is no basket and no online payment. Before accepting you can correct any detail by replying to the quote. HolaStudio keeps the quote and your acceptance, and sends you a copy whenever you ask. The contract may be concluded in Spanish, English, French, German or Dutch, according to the language of the conversation.

Prices and taxes

Prices on this site are in euros and do not include VAT, which is added at the current rate (21 % today). The quote always shows the final price including VAT and its breakdown. If the VAT rate changed, the rate in force on the date of each invoice would apply.

Travel is included in Torrevieja, Orihuela, Orihuela Costa, Guardamar del Segura, Rojales and Ciudad Quesada. Outside those towns it is calculated and shown in the quote, before starting.

A price change does not affect jobs already accepted or the month already paid. For a monthly plan in progress, notice is given in writing at least 30 days in advance, and you may cancel before it applies.

Monthly plans and launch pack

• Each monthly plan (those for shops and restaurants, the one for estate agencies and any added later) has the price, monthly content and, if there is one, the minimum term shown on the prices page and in the accepted quote.
• One-off packs, such as the launch pack for agencies, are not subscriptions and do not renew.

Monthly plans are invoiced monthly, in advance, at the start of each month, and renew automatically every month until you cancel them.

You may cancel at any time by writing to info@holastudiovideo.com or by WhatsApp. Cancellation takes effect at the end of the month already paid; if the plan has a minimum term, not before that term ends. The month already started is not refunded.

If online payment for a plan is offered in future, the quote and these terms will say so, together with how to cancel it.

Quoted jobs

Brand videos, one-off shoots, editing of the client's footage, virtual tours, photography of new-build developments, hotels and holiday rental homes and any other work not included in a plan are quoted in writing at a fixed price before starting.

Payment and invoicing

Payment is by bank transfer: at the start of each month for monthly plans, and in two instalments for quoted jobs, as stated in the quote. Every payment has its invoice.

If a payment is not received on time, HolaStudio may suspend the service, after written notice, until it is settled.

Delivery, revisions and shoots

Delivery times are stated for each service and in the quote, and run from the moment HolaStudio has done the shoot or has the complete material. Files are delivered digitally, via a download link.

Each piece includes one free revision of the edit. Further revisions, or reshooting, are quoted separately, unless the fault lies with HolaStudio.

If weather or another cause beyond both parties' control prevents an outdoor shoot, the date is changed at no cost to anyone. If you need to change the date of a shoot, let us know as soon as possible and another date will be found.

The client's part

• Provide access to the premises or property on the agreed date, with any permissions needed (for example from the owner or the community of owners).
• Inform the people who will be present at the shoot and make it possible for them to give or refuse their image authorisation.
• Give truthful information about what is to be shown and use the pieces lawfully, without presenting as real what is not.
• Hold the rights to the material it provides (logos, photos, videos, music) and answer for it towards third parties.

Rights in the delivered files

HolaStudio remains the author of its photos and videos. Once paid for, the client may use the delivered files for its own communication and advertising (website, social media, portals, adverts and print), in any country, with no time limit and nothing more to pay. It may not sell them or assign their use to third parties as a separate work, unless agreed in writing.

Music and other third-party elements included in a piece are used under a licence covering the agreed use. If that licence has any limit, it is stated in the quote.

HolaStudio only shows a job as an example or in a portfolio if the client authorises it in writing. Image authorisations of the people who appear are handled as explained in the legal notice.

Right of withdrawal

Anyone contracting as a business or professional has no right of withdrawal.

If you contract as a consumer at a distance or off premises, you may withdraw from the contract within 14 calendar days of its conclusion, without giving reasons, under articles 102 and following of Spanish Royal Legislative Decree 1/2007. It is enough to state it clearly by email to info@holastudiovideo.com or in writing to the address above, for example using the model below.

If you expressly ask for the service to begin during those 14 days and then withdraw, you will pay the proportional part of what has been provided up to that point (article 108.3). If the service has been fully provided within the period, with your prior express consent and your acknowledgement that you thereby lose the right, you can no longer withdraw (article 103.a).

Any amount due back to you will be refunded within 14 calendar days of your notice of withdrawal, using the same means of payment.

Conformity and complaints

If a delivered piece does not match what was contracted, it is corrected at no cost. Consumers also enjoy the guarantees provided by law.

Any complaint or claim can be sent to info@holastudiovideo.com or in writing to the address above, and is answered in writing. Consumers may also turn to the consumer affairs services of their region.

Liability

Towards clients who contract as a business or professional, HolaStudio's total liability for any matter related to the service is limited to the amount that client has actually paid it in the twelve (12) months before the event giving rise to it, and loss of profit and indirect damage are excluded. HolaStudio does not guarantee any particular commercial result (sales, lettings, bookings or viewings).

HolaStudio is not liable for failures or delays due to force majeure or causes beyond its reasonable control.

Nothing above limits liability for wilful misconduct or gross negligence, nor the rights the law grants to consumers.

Personal data

Data processed to prepare and provide the service is governed by the privacy policy.

Changes, applicable law and jurisdiction

HolaStudio may update these terms. The version applicable to each job is the one in force when the quote is accepted. For a monthly plan in progress, a change is notified in writing at least 30 days in advance and you may cancel before it applies.

These terms are governed by Spanish law. For any dispute, the parties submit to the courts of Alicante, unless the client is a consumer, in which case the courts of their place of residence have jurisdiction.
